Power of President: Rule of Government

The political crisis, which began on March 18, 2016 when nine MLA's of Congress with 27 BJP legislators met the Governor K.K Paul for the dismissal of the Congress government in Uttrakand. When this news came, and Paul met Harish Rawat, Chief Minister of Uttrakand, Rawat just said that he is enjoying his win with majority of seats in election, to which Governor Paul, gave him the deadline to prove his majority latest by March 28, 2016. Later, Saket Bahuguna was suspended, one of the nine rebel Congress MLA and later Harak Singh, Congress MLA presented a Sting Video to the press where Rawat was using illegal ways to prove his majority and which was then refused by Rawat that it's all fake and therefore Mr. Rawat, suspended all Rebel MLAs under anti-defection law.

President Rule was imposed before the day when no confidence vote has to be done, and Rawat blamed Harak Singh Rawat and former CM Vijay Bahugana for the downfall of Rawat's government and later the crisis became more complicated when senior BJP Leader and Union Finance Minister posted that Mr Rawat is doing horse trading and disqualification of MLAs to alter the composition of house. but what impact president rule is going to bring on politics of Uttarakhand and moreover what this jargon of President Rule is?

President Rule: According to Section 356, if any government of a particular state fails or State government fails to work, then President Rule is imposed to that state. It could be imposed under circumstances such as:

·      Breakdown of coalition

·      Loss of majority in assembly

·      Unavoidable reasons led to postpone of election

·      Chief Minister not elected due to failure of State Legislature

Implication of President Rule

When President's rule is forced, the assembly stops to work and the state goes under the Central government's immediate control. The assembly is for the most part kept in suspended activity. The power of the state assembly get to be exercisable by or under the power of Parliament. The executive power shifts from the board of minister to the governor.

When forced, President's standard must be endorsed by Parliament inside a time of two months. It can't keep going for over six months unless its augmentation is endorsed by Parliament.

President Rule has been imposed in many states like Jammu and Kashmir, Arunachal Pradesh, Jharkhand, Himachal Pradesh and many other states with the largest tenure in Jammu and Kashmir for 6 years and 264 days.
